Terms of Use

Article 1 (Purpose)
These terms and conditions are designed to regulate the rights, obligations, and responsibilities of the cyber mall and users in using Internet-related services (hereinafter referred to as “Services”) provided by BFD (hereinafter referred to as “Mall”) operated by BFD Company (e-commerce service provider).

※「This terms and conditions shall apply mutatis mutandis to electronic transactions using PC communication, wireless, etc., as long as it does not contradict those nature.」


Article 2 (Definition)
① “Mall” refers to a virtual business place set up to trade goods or services (hereinafter referred to as “goods, etc.”) by BFD Company using information and communication equipment such as computers, and it is also used in the sense of service provider operating a cyber mall.

② "User" refers to a member and non-member who has accessed the "Mall" to use the services provided by the "Mall" in accordance with these terms and conditions.

③ “Member” refers to a person who has registered as a member by providing personal information to the “Mall,” constantly receives information from the “Mall,” and can continue to use the services provided by the “Mall.”

④ “Non-member” refers to a user who uses the services provided by the "Mall" without registration.


Article 3 (Statement, Explanation, and Amendment of Terms and Conditions, etc.)
① The "Mall" shall, for easy recognition by users, display the contents of this terms and conditions, name of company and representative, business address(including an address handling customer complaints), phone number, email address, business license number, e-commerce registration number, and the name of personal information manager on the initial service screen (front) of Ecru Edited. Provided, that only the content of these terms and conditions may be displayed through a link page by users.

② The "Mall" shall provide a separate link or pop-up screen so that users can understand important details such as subscription withdrawal, delivery responsibilities, refund conditions among the contents set forth in the terms and conditions before the user’s final agreement to these terms and conditions.

③ The "Mall" shall make amendments within the permissible range without violating applicable laws such as the 「Act on Consumer Protection in Electronic Commerce, etc.」, 「Act on Regulation of Terms and Conditions 」, 「Framework Act on Electronic Transaction」, 「Digital signature Act」, 「Act on Promotion of Information and Communications Network Utilization」, 「Act on Door-To-Door Sales」, and 「Consumer Protection Act」.

④ The "Mall" shall specify the effective date and the reasons for amendment of the terms and conditions and notify them on the initial screen of "Mall" with current terms and conditions from seven days before the effective date until the day before the effective date.
However, if the contents of the terms and conditions are changed unfavorably to the user, contents of the amendment shall be notified with a grace period of at least 30 days in advance. In this case, the "Mall" shall clearly compares and displays the content before and after the amendment so that user can easily understand it.

⑤ When the "Mall" amends the terms and conditions; in that case, the amended terms and conditions shall apply only to contracts concluded after the date of application, and the terms and conditions before the amendment shall apply to contracts already concluded. Provided, that the provisions of the amended terms and conditions shall apply when the user who has already entered into a contract transmits his/her wish to be subject to the provisions of the amended terms and conditions to the "Mall" within the notice period of the amended terms and conditions under Paragraph 3 and receives the consent of the "Mall."

⑥ Matters not specified in these terms and conditions and interpretation of these terms and conditions shall comply with the 「Consumer Protection Act in Electronic Commerce, etc.」, the 「Act on the Regulation of Terms and Conditions」, 「Guidelines for the Consumer Protection in Electronic Commerce, etc.」, set by the Fair Trade Commission, and related laws or commercial practices.


Article 4 (Provision and Change of Service)
① The "Mall" shall perform the following duties:
1. Provide information regarding goods or services and conclude purchasing contracts.
2. Deliver goods or services on purchase contract.
3. Other duties designated by the "Mall."

② The "Mall" may change goods or services provided in future terms and conditions if goods or services are sold out or technical specifications are changed. In this case, the "Mall" shall immediately specify the change of goods or services and the delivery date, and notice them on the page where present goods or services are displayed.

③ When the contents of the service contracted with the user to be provided by the "Mall" are changed for reasons such as out of stock or change in technical specifications, the reason shall be immediately notified to the address where the user can be notified.

④ In case of the preceding paragraph, the "Mall" shall compensate the user for the damages caused by it. Provided, that this shall not apply when the "Mall" proves that the cause is not by its intention or negligence.


Article 5 (Suspension of Service)
① The "Mall" may temporarily suspend its provision of Services for the following reasons: maintenance, replacement, out-of-order, and disconnection of information and communications equipment such as computers.

② The "Mall" shall compensate the user or third parties for the damages caused by the temporary suspension of services due to the reason in Paragraph 1. However, this shall not apply when the "Mall" proves that the cause is not by its intention or negligence.

③ In case of a conversion of the business item, abandonment of business, merging between businesses, etc., the "Mall" shall notify the user of it as specified in Article 8 and compensate the consumer under the initial conditions suggested by "Mall." Provided, that the mileage or reserves of users shall be paid to user in goods or cash equivalent to the currency value used in "Mall" when the "Mall" does not notify such standard of compensation.


Article 6 (Membership)
① User shall apply for membership by expressing their intent to agree to these terms and conditions after filling out information of membership registration according to the registration form set by “Mall.”

② "Mall" shall register user as a member who has applied for membership as in Paragraph 1 unless they fall under any of the following subparagraphs.
1. When the applicant has previously lost membership under Article 7 (3) of these terms and conditions. Provided, that it shall not apply to the case that applicant has obtained approval for re-registration as a member of the “Mall,” and three years have passed since the loss of membership under Article 7 (3).
2. When there is false information, omission, and typo in the registration form.
3. When it is deemed that registering user would present technical difficulties to the "Mall."

③ The time of establishing the membership contract is when the consent of the “Mall” reaches the member.

④ When there is a change in the registered information under Article 15 (1), the member must immediately notify the "Mall" about the change by e-mail or another method.


Article 7 (Withdrawal from Membership and Loss of Qualification, etc.)
① Members may request withdrawal at any time to the "Mall", and the "Mall" shall immediately process the withdrawal.

② When a member falls under any of the following reasons, the "Mall" may restrict or suspend membership.
1. When false information is registered at the time of application for the membership
2. When the payment for goods using the “Mall” and other "Mall" usage-related liabilities have not been paid on the due date for the payment.
3. When a member threatens the order of e-commerce such as interfering with others to use the "Mall" or the illegal use of the information
4. When a member uses the "Mall" to act against public order and morals prohibited by the law and these terms and conditions

③ The "Mall" may cancel the membership of the member whose membership was suspended or limited when the same actions are repeated twice or more or when the cause is not corrected within 30 days.

④ When the "Mall" cancels membership, the membership registration is deleted. In this case, the "Mall" shall notify the member and give at least 30 days or more to grant an opportunity to explain the cause before membership registration is deleted.


Article 8 (Notification to Members)
① Any notifications from the "Mall" may be sent by the email address specified by the member in advance with the "Mall."

② In case of sending notifications to unspecified members, the individual notices may be replaced with a display of notifications by "Mall" on the notice board on the website for one week or more. Provided, that the "Mall" shall send individual notice to a member regarding matters that may significantly influence their transaction.


Article 9 (Purchase Request)
Users of the "Mall" shall apply for purchase in the following or a similar manner, and the "Mall" shall provide the user with the following information in an ‘easy-to-understand’ manner to help in their request for purchase. Provided, that the application of subparagraphs 2 or 4 may be excluded in case of a member.
1. Search and select goods, etc.
2. Enter name, address, phone number, e-mail address (or mobile phone number), etc.
3. Confirm the contents related to the contents of the terms and conditions, services for which the right to withdraw subscription is restricted, and expenses such as shipping and installation fees.
4. Indicate agreeing to these terms and conditions and confirming or refusing the above subparagraph 3 (e.g., mouse click)
5. Give consent to request for the purchase of goods, etc., and confirmation thereof or confirmation of “Mall.”
6. Select payment method


Article 10 (Formation of Contracts)
① The "Mall" may not accept the request for purchase as in Article 9 when it falls under any of the following subparagraphs. Provided, that in case of signing a contract with a minor, the "Mall" shall notify that minor, or the legal representative may cancel the contract when the legal representative's consent is not obtained.
1. When there is false information, omission, and typo in the application details
2. When a minor purchases goods and services prohibited by the 「Youth Protection Act」, such as cigarettes and alcohol.
3. When it is deemed that accepting the other purchase request is significantly impeded by the “Mall” technology

② The contract is deemded to be concluded when the consent of the "Mall" reaches the user in the form of notification of receipt confirmation under Article 12 (1).

③ The acceptance of the "Mall" shall include information about confirmation of the user’s request for purchase, availability of sales, and correction or cancellation of the purchase request.


Article 11 (Payment method)
The payment method for goods or services purchased on the "Mall" may be made by available method among any of the following subparagraph. Provided, that the "Mall" shall not collect any nominal fee for the user's payment method, in addition to the price of goods, etc.
1. Different types of account transfers such as phone banking, internet banking, mail banking.
2. Different types of card payments such as prepaid cards, debit cards, credit cards.
3. Online bank transfer
4. Payment by digital currency
5. Payment by due upon receipt
6. Payment by points paid by the "Mall," such as mileage
7. Gift cards contracted with or approved by the "Mall."
8. Other payments by electronic payment methods, etc.


Article 12 (Notification of Receipt Confirmation / Change and Cancellation of Purchase Request)
① The "Mall" shall notify the user receipt confirmation when there is an user's purchase request.

② The user who has received the notification of receipt confirmation may request change or cancellation of the purchase application very after receiving the notification of receipt confirmation when there is a discrepancy in the expressions of intent, and the "Mall" shall process the request accordingly without delay when the request for change or cancellation is made before delivery. Provided, that the provision of Article 15 (Withdrawal of subscription, etc.) shall apply when the payment has already been made.


Article 13 (Provision of goods, etc.)
① Unless otherwise agreed, the "Mall" shall take necessary other measures such as customizing production and packaging to deliver goods, etc., within seven days from the date the user makes a subscription. Provided, that when the "Mall" has already received all or part of payment, the measure for the delivery shall be taken within two business days from receipt of all or part of the payment. In this case, the "Mall" shall take appropriate measures so that the user can check the supply procedure and progress of the goods.

② The “Mall” shall specify the delivery method, the person responsible for the delivery cost by the method, and the delivery period by the method for the goods purchased by the user. When the "Mall" exceeds the contracted delivery period, the "Mall" Shall compensate the user for the damages caused by it. Provided, that this shall not apply when the "Mall" proves that the cause is not by its intention or negligence.


Article 14 (Refund)
The "Mall" shall notify the user of the reason without delay when the goods, etc., which the user has applied for purchase cannot be delivered or provided due to reasons such as being out of stock. Also, the "Mall" shall take necessary measures or refund payment within two business days from the date of receipt. when payment for goods or services has already been made in advance.


Article 15 (Withdrawal of subscription, etc.)
① The user who conclude the purchase contract regarding goods, etc., with "Mall" may withdraw the subscription within seven days from the date of receiving the notification of receipt confirmation.

② Users may not return or exchange goods, etc., in case of goods, etc., are delivered when they fall under any of the following subparagraphs 1.
1. When the goods are lost or damaged due to a cause attributable to the user (provided, that the subscription may be withdrawn when the packaging, etc. is damaged to check the contents of the goods, etc.)
2. When the value of goods, etc. has significantly decreased due to the user's use or partial consumption
3. When the value of goods, etc. has significantly decreased to the extent that resale is difficult due to the passage of time
4. When the packaging of the original goods, etc. is damaged in case the goods, etc., the same performance can be duplicated

③ In case of subparagraph 2 through 4 of Paragraph 2, the user’s subscription withdrawal, etc., shall not be limited when the “Mall” did not take measures in advance such as specifying the fact that withdrawal of subscription is restricted in a place where consumers can easily find out or providing trial goods.

④ Notwithstanding the provisions of paragraphs 1 and 2, the user may withdraw subscription within three months from the date of supply of the goods, etc., or within 30 days of the date on which the user knew the fact or the date user was able to know if the contents of the goods, etc., are different from the contents of the display or advertisement or the contents of the contract are performed differently.


Article 16 (Effect of Withdrawal of Subscription, etc.)
① "Mall" refunds payment for the goods already paid within three business days when goods are returned from the user. In this case, the "Mall" shall pay the user for the delayed period with interest calculated by the number of days delayed with the overdue interest rate by multiplying the delay interest rate determined and announced by the Korea Fair Trade Commission for the delay period.

② Regarding refunding payment mentioned above, if the user made payment of Goods with a credit card or electronic money, the "Mall" shall immediately request those who provided such payment method to suspend or cancel the payment.

③ In case of any subscription withdrawal, the user shall bear the expenses arising from returning the goods, etc. The "Mall" shall not claim a penalty or compensation for the damages to the user for reasons such as withdrawal of subscription. However, in case of withdrawal of subscription because the contents of goods, etc., are different from the displayed or advertised contents or the contents of the contract are fulfilled differently, the "Mall" shall bear the costs of returning the goods, etc.

④ When the user bear the delivery fees for receival of the goods, etc., the "Mall" shall clearly indicate who will bear the cost when the subscription is withdrawn so that the user can easily understand.


Article 17 (Protection of Personal Information)
①The "Mall" collects a minimum amount of information required to fulfill the purchase contract when collecting user's information. The following items are required, and the others are optional.
1. Name
2. Address
3. Phone number
4. Preferred ID (In case of Members)
5. Password (In case of Members)
6. Email address (or mobile phone number)

② The "Mall" shall obtain the consent of the users when the "Mall" collects personal information which is available for the user's personal identification.

③ Provided personal information shall not be used for any other purpose or provided to a third party without the user's consent, and the "Mall" shall be liable for all of this matters. Provided, that exceptions shall be made for the following cases.

1. In case of providing the delivery company with the minimum user information (name, address, phone number) required for delivery
2. In case where it is necessary for statistical writing, academic research, or market research, and it is provided in a form in which a specific individual cannot be identified.
3. In case it is necessary for payment settlement according to the transaction of goods, etc.
4. In case it is necessary to verify one's identity to prevent illegal use
5. In case there is an unavoidable reason required by law or regulation

④ When the "Mall" is required to acquire the approval of the user under paragraphs 2 and 3; in that case, the "Mall" shall specify or notify matters under Article 22 (2) of the 「Act on Promotion of Information and Communications Network Utilization」 in advance, such as the identity of the personal information manager (affiliation, name, phone number, other contact information), the purpose of collection and use of information, matters related to the provision of information to third parties (recipient, the purpose of providing and contents of the information to be provided). Also, the user may at any time withdraw this consent.

⑤ Users may, at any time, request for view and correction of an error in their personal information possessed by the "Mall," and the "Mall" shall be liable for taking any necessary measures without delay. When the user requests to correct an error, the "Mall" shall not use the personal information until the error is corrected.
⑥ To protect personal information, the "Mall" shall limit the number of persons handling personal information to a minimum. Furthermore, the "Mall" shall be liable for any damages to users caused by loss, theft, leakage, falsification, and disclosure of personal information, including credit card and bank account information.

⑦ The "Mall" or any third party who received personal information from the "Mall" shall destroy all personal information without delay once the purpose of collected or provided personal information has been achieved.


Article 18 (Obligations of the “Mall”)
① The "Mall" shall not act against good public order and customs, or actions restricted by the law and these terms and conditions, and the "Mall" shall put its best efforts into providing goods or services on a sustainable and stable basis under the provisions in these terms and conditions.

② The "Mall" shall be equipped with a security system to protect users' personal information (including credit information) so that users can use the internet services safely.

③ The "Mall" shall be liable for compensating for goods or services when users take damages from (Unfair Labeling or Advertising) specified in Article 3 of the 「Act on Fair Labeling and Advertising」.

④ The "Mall" shall not send any profit-making commercial emails which users do not want.


Article 19 (Obligations for Member's ID and Password)
① The members shall be responsible for managing their ID and password, except for the case in Article 17.

② The member shall not allow any third party to use their ID and password.

③ The member shall immediately notify the "Mall" and follow the instructions of the "Mall" when a member recognizes that their ID and password are stolen or are being used by a third party.


Article 20 (Obligations of Users)
Users shall avoid the following actions:
1. Registration of false information when applying or changing
2. Illegal use of someone else's information
3. Change information displayed on the "Mall."
4. Transmission or posting of information (computer programs, etc.) other than the information set by the “Mall.”
5. Infringement of intellectual property rights such as copyrights of “Mall” and other third parties
6. Acts that damage the reputation of the “Mall” or other third parties or interfere with their business
7. Disclose or display any information containing an obscene or violent message, video, voice, and other information against good public order and customs on the "Mall."


Article 21 (Relationship between Linking "Mall" & Linked "Mall")
① The upper “Mall” and the lower “Mall” are linked with a hyperlink(e.g. the subject of hyperlink includes text, image, and video), the former is called the Linking "Mall" (Website), and the latter is called the Linked "Mall" (Website).

② When the Linking "Mall" specifies and notifies that it is not liable for any transaction with the user for any goods or services exclusively provided by the Linked "Mall" on the initial page of the website of the Linking "Mall" or a pop-up window, the Linking "Mall" is not liable for such transactions.


Article 22 (Vested Copyrights and Restrictions on Use)
① The copyright and other intellectual property rights for the works produced by the "Mall" shall belong to the "Mall."

② The user may not use or cause any third party to use information with intellectual property rights belonging to the "Mall" for profit-making use by copying, transmission, publishing, distribution, broadcasting, etc. without the prior consent of the "Mall."

③ The "Mall" shall notify the user when using the copyright belonging to the user according to these terms and conditions.


Article 23 (Dispute Resolution)
① The "Mall" shall apply and reflect the opinion or complaint made by the users. And the "Mall" shall install and operates a damage compensation processing organization to compensate consumers’ damages.

② The "Mall" shall prioritize any opinion or complaint made by user(s). Provided, that the "Mall" shall notify the user of the cause and the final settlement schedule when it cannot deal with the matter promptly.

③ It may be subject to mediation by the Fair Trade Commission or a dispute mediation agency requested by the mayor/governor when user requests remedy for the damage regarding an e-commerce dispute between the "Mall" and the user.


Article 24 (Jurisdiction and Governing Law)
① All e-commerce-related lawsuits between the "Mall" and an user shall be based on the user's address at the time of indictment. When an address is nonexistent, the lawsuit shall fall under the exclusive jurisdiction of the district court in the vicinity of the user's residence. Provided, that the lawsuit shall be filed to the competent court on the 「Civil Procedures Act」when the address or residence of the user is not clear at the time of indictment or when the user is a foreign resident.

② Any and all e-commerce-related lawsuits between the "Mall" and an user shall be governed by Korean Law.

Addendum (Effective Date) These terms and conditions are effective from January 4, 2020.
